Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Instacalorie mobile application and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What Instacalorie does

Instacalorie lets you photograph your meals. Our systems, including artificial intelligence, analyze each photo to identify the food and estimate its calories, protein, fat, carbohydrates, and related nutritional information. The photo and the data derived from it are saved to your account so the Service can build your daily, weekly, and monthly nutrition history.

2. Estimates, not medical advice

All nutritional values produced by the Service are automated estimates. They can be inaccurate or incomplete, and portion sizes, ingredients, and preparation methods may not be detected correctly. The Service does not provide medical, nutritional, or health advice, and it is not a substitute for consultation with a qualified professional. Do not rely on the Service to manage a medical condition, including diabetes, allergies, or eating disorders.

3. Your account

You sign in with your Apple Account using Sign in with Apple. You are responsible for the activity that occurs under your account and for keeping your device secure. You must be at least 13 years old (or the minimum age required in your country) to use the Service.

4. Information you provide

To improve your estimates and track your progress, you may provide profile information (such as your name, sex, birthday, height, and weight), nutrition and weight goals, body type, and activity level. Providing this information is optional, but some features may not work without it.

5. Data from your device

With your permission, the Service may read activity information from your device (such as steps and physical activity) and use your location to better understand the context of your meals, such as where a dish was photographed. You can withdraw these permissions at any time in your device settings; the related features will stop working, but the rest of the Service remains available.

6. Your content

You keep ownership of the photos you take. By using the Service you grant us a limited license to store, process, and analyze your photos and the data derived from them, solely to operate and improve the Service as described in our Privacy Policy.

7. Subscriptions

Some features may require a paid subscription ("Premium"). Subscriptions are billed through your Apple Account and renew automatically until cancelled in your App Store settings. Prices are shown before purchase. Where required by law, you may be entitled to a refund from Apple; we do not process payments directly.

You can delete your account and all associated data at any time from the app (Account, then "Delete account and all data"). We may suspend or terminate accounts that violate these Terms. Upon deletion, your data is removed as described in the Privacy Policy.

10. Disclaimer and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, Instacalorie shall not be liable for any indirect, incidental, special, or consequential damages, or for decisions you make based on nutritional estimates produced by the Service.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app or on this page, and the effective date above will be updated. Continuing to use the Service after a change means you accept the updated Terms.
